Probate cash advances can range from $2,500 to $1,000,000, and the process can begin as soon as the probate petition is filed by your attorney.
Probate is a legal process that is designed to wind up the affairs of the decedent, and distribute assets of the estate to individuals by will, trust or by operation of law. In probate a person is usually appointed to close out the affairs of the decdent. This person is known as either an administrator ( a person appointed if no will is admitted, or there is a will with no named executor), or an executor ( a person named in the will to manage winding up the affairs of the estate).
Probate administration can take up to two years or more. The more is often related to parties initiating litigation over the validity of a will, or the right to a distributive share of the estate. Whichever reason is the basis for the litigation, probate administration is slowed down. Unfortuneately, this can often lead to consuming the value of the estate by attorney's fees.
Do note that certain assets may not require probating, and therefore may provide you with resources you need in order to meet your financial obligations. They are assets that have a "Pay-on-Deat"h designation or are assets which are held in Joint Tenancy, an example of which are: Jointly owned real or personal property, proceeds of life insurance, retirement accounts, and annuities. These assets pass to the surviving joint owners or named beneficiary.
